indiagrows.com (“India Grows”) is managed by Medicto Ltd, a company registered in England and Wales, United Kingdom (company number 10447946). In these terms, “we” and “us” mean Medicto Ltd, and “you” means anyone who visits or uses India Grows. By creating an account or using the site, you agree to these terms, our privacy policy and our community guidelines. If you do not agree, please do not use the site.

1. What India Grows is

India Grows is a networking site where business people of Indian origin can post and discover business opportunities, such as partnerships, investments, trade, distribution and businesses for sale, contact each other, and find professionals in our Professionals directory. We also list events of interest to the Indian diaspora. We provide the platform only. We do not arrange, negotiate, advise on or take part in any deal (unless specifically mentioned).

2. We are not a party to any deal (unless specifically mentioned)

• We are not a broker, agent, adviser, investment firm, escrow service or party to any deal or conversation between members (unless specifically mentioned).
• We review deals before they go live to keep out obvious spam and abuse, but we do not verify members’ identities, claims, businesses, goods, funds or documents, and approval is not an endorsement.
• Nothing on India Grows is financial, investment, legal, tax or other professional advice. Medicto Ltd is not a regulated entity. It is not authorised or regulated by the Financial Conduct Authority or any other regulator, and India Grows is not a place to promote regulated investments to the public.
• Any agreement you make is solely between you and the other party. You are responsible for your own due diligence, contracts, licences, tax and compliance with the law.

3. Who can join

• You must be at least 18 and able to enter into a binding contract.
• India Grows is a community for people of Indian origin, including NRIs, PIOs and OCI holders, and you confirm this when you register.
• You must give accurate details about yourself and your business and keep them up to date. One person may hold one member account.
• We log you in by emailing a one-time code to your registered email address, so keep that email account secure and never share login codes with anyone. You are responsible for activity on your account. Tell us straight away if you think someone else has used it.

4. Posting deals

• Every deal is reviewed by our team before it is published. We may approve, edit for formatting, decline or remove any deal at our discretion.
• Deals expire automatically 90 days after they go live, or earlier if you choose an earlier date. Editing a deal does not extend it.
• Deals must be genuine, lawful, accurate and yours (or your business’s) to offer. Do not put phone numbers or email addresses in deals; members can contact you through the site.
• You are responsible for any licences, permits, approvals or disclosures that your deal requires in each country involved.

5. What is not allowed

You must not use India Grows to:

• post fraudulent, misleading or “advance fee” offers, or ask members to pay fees before a genuine deal exists;
• promote unauthorised investments, deposit-taking, money transfer, cryptocurrency schemes or anything that requires a financial licence you do not hold;
• trade in illegal, counterfeit, stolen or restricted goods, or deal with sanctioned persons, countries or goods;
• harass, threaten, discriminate against or impersonate anyone, or share other people’s personal data without permission;
• spam members, scrape the site, or interfere with its security or operation.

Please report anything that breaks these rules using the Report button. We may remove content and suspend or close accounts that break these terms, and we may share information with authorities where required by law.

6. Messages and contact between members

Only registered members can contact deal owners. Deals are shown without the owner’s name or contact details. When you contact a deal owner, your name, company, industry, country, email address, mobile number and LinkedIn profile are sent to them with your message. Be careful: never send money, deposits or bank details to someone you have not independently verified, and meet in person or use professional advisers before committing to a deal. We are not responsible for how members behave towards each other, on or off the site.

7. Professionals directory

You can join India Grows as a professional, or list yourself later from My Account, to appear in our Professionals directory. If you do:

• your profile is shown to approved India Grows members only (not to the public or search engines), who can see your name, photo (if you add one), professional title, company, profession, city, country, LinkedIn profile and short profile, and can message you through India Grows. Your email address and phone number are not shown;
• everything in your profile must be accurate and up to date. You must hold any qualification, licence, registration or authorisation you describe, and you must follow the rules of your profession and any regulator that applies to you. Don’t include your email address, phone number or any misleading claims;
• we check each profile, and each change to it, before it appears, and we may decline, hide or remove a profile at any time, for example if it breaks these terms or our community guidelines. You can remove your profile at any time in My Account.

If you contact or engage a professional: India Grows only lists professionals for networking. We do not verify their identity, qualifications, licences, insurance or regulatory status, and listing someone is not an endorsement or recommendation. Any work they do for you is between you and them, and we are not a party to it (unless specifically mentioned). Check their credentials and regulatory status yourself, and agree terms and fees with them directly, before you engage them.

8. Events

We list events that may interest the Indian diaspora, such as networking, conferences, trade missions, festivals and community events, on our Events page. Unless an event listing specifically says otherwise:

• the event is run by the organiser named in the listing, not by India Grows or Medicto Ltd, and we are not a party to any booking or ticket you buy;
• registration, tickets, payment, refunds and cancellations are handled by the organiser on their own website and under their own terms, and any questions or complaints about the event should go to them;
• listing an event is not an endorsement. We do not verify organisers, speakers, venues or the event itself, and details such as dates, times, prices and locations can change. Check them with the organiser before you book or travel. Times are shown in the event’s local time;
• links to organisers’ websites are provided for convenience. We are not responsible for those websites, their content or how they use your personal data.

You attend events at your own risk and are responsible for your own safety, travel and belongings. We may add, change or remove event listings at any time. If you would like us to consider listing an event, email the details to [email protected].

9. Special offers

Approved members can offer discounts from their business to other members on our Special offers page, and see the offers other members post. If you post an offer:

• it must be a genuine offer from your business, or one you are allowed to promote, with accurate details and its conditions stated clearly (for example a minimum spend, first order only or one per customer). It must follow consumer protection, pricing and advertising law wherever you make it;
• you must honour it for India Grows members as described until it ends. If you can no longer honour it, edit or delete it straight away in My Account;
• it is shown to approved India Grows members only (not to the public or search engines), as offered by “an India Grows member”, with the business name, logo, discount, details, discount code and web page you give. You must own the logo you upload or have permission to use it;
• we check each offer, and each change to it, before it appears, and we may decline, hide or remove an offer at any time, for example if it breaks these terms or our community guidelines. Offers end on their end date, or 90 days after they go live, whichever is sooner. You can edit or delete your offers at any time in My Account.

If you use an offer: unless the listing specifically says otherwise, the offer is made by the business named in it, not by India Grows or Medicto Ltd, and we are not a party to anything you buy. Prices, payment, delivery, refunds and complaints are between you and the business, under its own terms. We do not verify businesses or their offers, listing an offer is not an endorsement, and we do not guarantee that a business will honour it. Check the offer and its conditions with the business before you buy. Links to businesses’ websites are provided for convenience; we are not responsible for those websites, their content or how they use your personal data.

10. Your content

You keep ownership of what you post. You give Medicto Ltd a worldwide, non-exclusive, royalty-free licence to host, display, reproduce and moderate it for the purpose of running and promoting India Grows. You confirm that you have the right to post it and that it does not infringe anyone’s rights. The India Grows name, logo, design and site content (other than members’ content) belong to Medicto Ltd.

11. Fees

India Grows is currently free to use. If we introduce paid features, we will tell you the price before you pay, and paid features will have their own terms.

12. Availability and changes

We aim to keep India Grows running smoothly, but we do not guarantee it will always be available or error-free. We may change, suspend or withdraw features at any time.

13. Our liability

• India Grows is provided “as is”. To the extent the law allows, we are not liable for any loss arising from deals, events or special offers listed on the site, professionals listed on the site or work they do for you, information posted by members, dealings between members, or the site being unavailable.
• We are not liable for loss of profit, business, revenue, opportunity or data, or for any indirect or consequential loss.
• Where we are liable to you, our total liability is limited to £100.
• Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law.

You agree to compensate us for reasonable losses and costs we suffer because of your breach of these terms or your dealings with other members.

14. Ending your account

You can stop using India Grows at any time and ask us to delete your account. We may suspend or close your account if you break these terms or if we reasonably need to in order to protect members, the site or ourselves. Sections 2, 7, 10 and 13 continue to apply after your account ends.

15. Changes to these terms

We may update these terms from time to time. The current version will always be on this page with its “Last updated” date. If you keep using India Grows after a change, the new terms apply.

16. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, except where the law of your country gives you mandatory rights that cannot be excluded. If any part of these terms is found unenforceable, the rest still applies.
